MEP SHOCKED AND ANGRY AS IRELAND FINED €2M OVER WASTE WATER BREACHES

first_imgIndependent MEP Marian Harkin today described herself as “shocked and appalled” by the decision of the European Court of Justice (ECJ) to impose heavy fines onIrelandfor breaching EU legislation on wastewater systems. Speaking from Brussels, Harkin said the judgement was “shocking from two different perspectives: firstly, it is 19 years since we should have implemented the 1975 Waste Directive and despite repeated warnings and previous Court Cases, we have not taken the necessary steps to comply.“Secondly I also consider that a €2 million lump sum fine plus daily fines of €12,000 is extortionate on a Member State that is on its knees financially.” She accused governments of failing to address the issue for a generation“We should never have left ourselves open to this in the first place. Successive Governments have ignored the issue,” she said.“I am on the record over many years both in Dáil Eireann and the European Parliament as calling on the Irish Government to put in place a programme using European funding to upgrade rural waste water systems or septic tanks. We completely ignored the issue and concentrated solely on urban systems.“These decisions are now coming back to haunt us. There is no excuse for not putting in place the inspection regime required and for not finalising the measures necessary to ensure compliance with the previous ECJ Judgement. We knew well in advance the date of this judgement, we knew what we had to do and yet we have failed to deliver – there really is no excuse for it. “However, in regard to the amount of the penalty, it is unreasonable to ask a State to pay €12,000 per day as well as a €2 million lump sum plus all costs when that Member State is so heavily indebted. The fines are not proportionate and in no way reflect our ability to pay.“I am now calling on the government to bring forward immediate emergency proposals to finalise the measures needed to ensure compliance.
